Earcatch Terms of Use


ARTICLE 1 Definitions

User: the natural person who has created an Earcatch account with Earcatch.

Devices: the devices on which Content can be played. For up-to-date information about the devices you can use, please visit the Website.

App: the Earcatch App.

Content: all audiovisual material, such as audio description, subtitles, sign language, and trailers, offered through the Service.

Service: the Earcatch service.

Earcatch: the private limited liability company, Earcatch International B.V., with its registered office at Havenstraat 76a, 1271 AG Huizen, The Netherlands.

Terms and Conditions: these subscription terms and conditions, which apply to the Agreement between the Parties.

Website: the Website of the Earcatch Service: earcatch.eu.


ARTICLE 2 Creating an Earcatch Account

2.1 In order to use our Service, you must create an Earcatch Account.

2.2 Only persons aged 16 and older may register. Minors may only use our Service under the supervision and with the consent of an adult.

2.3 When creating an Earcatch Account in the App, users must provide both their email address and username and choose a unique password. By logging into the App, you can view or change the information stored in your profile.

2.4 Your Earcatch Account and the associated password are granted for personal, non-commercial use only. The password must be kept confidential and may not be shared with persons outside your household. "Household" means all devices linked to your primary residence and used by persons living there.

2.5 Misuse and/or improper use of the Earcatch Account or password in combination with your username is at the expense and risk of the User.

2.6 Earcatch reserves the right to block access to the Service if a user acts in violation of these terms and conditions.


ARTICLE 3 - The content

3.1 The Content available on the Service will vary continuously. Earcatch reserves the right to change the range of Content without prior notice. This means that certain accessibility services such as audio description, subtitles, and sign language may be added or removed at any time, depending on, for example, licenses, popularity, or technical reasons. Although Earcatch strives to offer as attractive and varied a range as possible, it is possible that titles may no longer be available. For the current availability of specific Content, it is advisable to consult the Website or the App regularly.

3.2 The Content is offered under certain age and content classifications, according to the classification of Kijkwijzer. The User declares that they are at least the age required for the specific Content.


ARTICLE 4 - Technical requirements

4.1 Specific technical requirements and restrictions for receiving and playing Content on different types of Devices, such as smartphones or tablets, are listed on the Website. For (certain types of) Content and Devices, these technical requirements and restrictions may change from time to time due to technological developments or requirements of Earcatch's licensors.


ARTICLE 5 - License

5.1 By creating an Account for the Earcatch Service, we grant you a limited, non-exclusive, and non-transferable right to use the Content in accordance with the Terms and Conditions, exclusively for personal and non-commercial use on a Device. Any other use of the Content is not permitted and is expressly reserved to Earcatch and its licensors.

5.2 It is not permitted to use the Content commercially, copy it, or provide it to third parties. You may also not disclose the Content outside the private sphere or enable others to do so. This applies, among other things, to publicly accessible places, areas with an entrance fee, catering establishments, and communal areas in, for example, hotels or institutions.

5.3 As a User, you must comply with the Terms and Conditions and applicable legislation, such as rules relating to intellectual property, when using the Service. If we determine that you are disclosing, copying, making available to third parties, or distributing Content in violation of the Terms and Conditions or the law, we may report this to the police. All costs and damages incurred as a result, including both material and immaterial damages, will be recovered from you. In such a case, you will also be immediately excluded from any use of the Service.


ARTICLE 6 - Intellectual and industrial property rights

6.1 All intellectual property rights relating to or arising from parts of the Service - such as images, user interfaces, audio and video clips, Content, editorial content, scripts and software necessary for the functioning of the Service - belong to Earcatch and/or its licensors. The User is not permitted to copy any part of the Content in any way, unless expressly permitted by these Terms and Conditions.

6.2 The User cannot derive any rights from entering into this Agreement with regard to the content of the Service or the Content. All Content requested by you remains the property of Earcatch or its suppliers/licensors.

6.3 The Content contains technical security measures, implemented by Earcatch and/or its licensors, to protect the Content and limit the use of the Content in accordance with the Terms and Conditions. It is therefore not permitted to:

a) copy, offer, distribute, sell, rent, transfer, (sub)license, distribute, make available to third parties, or grant third parties access to (parts of) the Content by providing the necessary data;

b) (attempt to) circumvent or crack the encryption and/or security of the (transit of) the Content and/or the file and/or the software with which the Content is offered to a User or through which the Content is played, or to circumvent any technical measures implemented by or on behalf of Earcatch;

c) modify, change, translate, or create derivative works of the Content;

d) decompile, copy, reproduce, or modify the file through which the Content is offered in order to discover the initial specifications of the system and/or the design specifications, or otherwise edit the file in such a way that a code readable by humans is created;

e) reproduce or "burn" the Content and/or the file in which the Content is offered onto a physical medium, such as, but not limited to, CDs, DVDs, Blu-ray discs, USB sticks, etc., or any other physical media that may be developed in the future.

f) use the Content for artificial intelligence (AI) applications, including but not limited to training, testing, or improving so-called Large Language Models (LLMs) or other AI systems, in any form whatsoever. It is also expressly prohibited to collect, scrape, extract, or process the Content using automated means or software for any AI purpose.


ARTICLE 7 - Liability

7.1 Earcatch is not liable for any consequences or damage, direct or indirect, arising from the use of the Service or when it is unavailable. Examples include malfunctions, interruptions, incomplete information, or errors.

7.2 Earcatch makes no guarantees and is not responsible if you are unable to play Content due to problems with your own equipment or internet connection. The Website lists the minimum requirements and functionalities necessary to use Content.

7.3 Earcatch cannot guarantee that the Content will fully meet the expectations that Users may have based on marketing communications, such as trailers or synopses. Earcatch and/or its licensors accept no liability if the Content does not meet such expectations.

7.4 Earcatch is not liable for shortcomings on the part of third parties.


ARTICLE 8 - Force majeure

8.1 In the event of force majeure, Earcatch may, at its discretion, suspend the Service without having to pay compensation.


ARTICLE 9 - Applicability of terms and conditions

9.1 By using the Service, you accept the applicability of these Terms and Conditions.

9.2 Earcatch reserves the right to make changes to these Terms and Conditions from time to time. The most current version of the Terms and Conditions can always be consulted on the Website. By continuing to use the Service after these Terms and Conditions have been changed, you accept the applicability of the changed Terms and Conditions.

9.3 The invalidity of any provision of these Terms and Conditions shall not affect the validity of the other provisions of these Terms and Conditions.

9.4 The processing of personal data is subject to Earcatch's privacy statement, as published on the Website.


ARTICLE 10 - Applicable law and choice of forum

10.1 These Terms and Conditions and the Agreement are governed by Dutch law. Any disputes will be submitted to the competent court in Amsterdam.

Earcatch privacy statement


1. Introduction

This privacy statement applies to the processing of personal data by Earcatch and describes which personal data Earcatch processes and how it is used. Personal data is understood to mean: all data relating to the User that can be used to identify the User directly or indirectly. The data and information mentioned in this privacy statement may contain personal data.

Through the Earcatch Service, the User can purchase audiovisual translations, such as audio description, subtitles, sign language, and previews, via various Devices. Purchase of the Service is exclusively for end use under the applicability of Earcatch's Terms of Use. Earcatch is responsible for the processing of personal data for the purposes of the Website and the Service.

As explained further below, Earcatch collects data about Users when they first register for the Service (via Earcatch ID), when they subsequently use the Service, and during every contact between Earcatch and the User. This information is used (sometimes in combination with other information) to provide the Service, to improve the Service or tailor it to the User's personal preferences, to provide support to the User, and for the other purposes described in this privacy statement.


2. Definitions

Account: The personal registration, consisting of the username and password, with which the User gains access to the Service. Devices: The devices on which Content can be played. Content: Audiovisual translations, such as audio description, subtitles, sign language, translation, and trailers and previews.

Service: The service provided by Earcatch that enables Users to purchase Content via various Devices and exclusively for end use, subject to the Earcatch Terms of Use.

User: The natural person who is not acting in the course of a profession or business and who purchases Content from Earcatch.

Privacy Statement: This privacy statement of Earcatch. Earcatch: The private limited liability company, Earcatch International B.V., with its registered office at Havenstraat 76a, 1271 AG in Huizen (Chamber of Commerce number 77214110).

Website: The Website of the Earcatch Service: located at www.earcatch.nl and www.earcatch.eu.


3. How we collect information

Earcatch collects information about Users in the following ways:

Directly from the person concerned: for example, when the person concerned registers as a User to use the Service, when they sign up for a special offer or promotion from Earcatch, when a User sends an email or otherwise contacts Earcatch, for example with questions about the use of the Service.

As a result of using the Website: anyone can visit the Website. Earcatch does not use cookies to collect data about visits to the Website. As a result of using the Service: users have access to the Content within the Service via their Account. Earcatch can use the Account to keep track of which Users are using the Service.

From third parties: for example, if a visitor to the Website or a User uses social network features that are integrated into our Service, Earcatch may receive certain information from the relevant social network, such as Facebook, Instagram, and Bluesky.


4. What information do we collect about Users

Earcatch collects and processes the following information about Users for the purposes explained elsewhere in this privacy statement:

Contact details and Account: Earcatch stores the information that Users provide when they register using the Earcatch ID (i.e., first name and email address).

Information about the use of the Website and the Service: Earcatch may collect general information about the use that Users and Website visitors make of the Website, and the use that Users make of the Service, for example by keeping track of how often and from which IP address the User logs in, which browser is used to visit the Website, or which type of Device is used to access the Content.

Information about Earcatch's app(s): When using Earcatch's app(s) on a mobile Device, the unique identification code of that Device may be recorded. Earcatch may also record the type of Device used or the version of the operating system used.

Information about responses to emails: When Earcatch sends emails to Users, information may be collected about how the User responds to such emails, for example, the number of times the email is opened or the links in it are clicked. Information resulting from contact with the User: for example, if a User asks a question by email or contacts the telephone helpdesk.


5. How we use this information

To provide the Service: Earcatch uses the Account, for example, to grant you access to the Content, and other information provided during registration (such as name and email address) to verify that the User meets the requirements. Contact details provided may be used to inform you about changes to the Service or scheduled maintenance (service emails), for example.

To improve the Service and identify general trends: Earcatch uses the (usage) data of all Users to analyze in general terms how the Service is used and what trends can be observed, in order to make better-informed decisions about, for example, the further development of the Service and the range of Content offered. More technical trends may also be tracked for this purpose, such as the types of Devices or browsers a User uses to access the Content.

To prevent abuse: Earcatch also processes information about Users and their use of the Service to prevent abuse of the Service and the Content and to safeguard the rights of others (including the rights holders to the Content).

Compliance with laws and regulations: information may be used to comply with laws and regulations applicable to Earcatch, to handle disputes, and to carry out audits.

For other reasons permitted or required by law: in exceptional circumstances, Earcatch may also use data for other purposes if permitted or required by law. For example, if Earcatch is required to provide data by order of a court or investigative authorities.


6. Users' rights with regard to their information

Users can access the information processed by Earcatch at any time and free of charge and modify it if they wish. Users can also object to receiving information or targeted offers from Earcatch by email or telephone.


7. Persons under the age of 16

Persons who have not yet reached the age of 16 (minors) may only register as Users with the consent of a parent or legal guardian. The parent(s) or legal representative of the minor User should read this privacy statement in the interest of the minor User and may exercise the rights of the User in question on behalf of the minor User. Earcatch recommends that parents or legal guardians supervise the use of the Service by a minor User or user and make such Users aware of the use that may be made of their personal data on the basis of this privacy statement.


8. Security of information

Earcatch maintains a level of security when processing information about Users and visitors to the Website that is sufficient, given the state of the art, to prevent unauthorized access to, modification, disclosure, or loss of personal data.


9. Links to third-party websites

The Website may contain links to other websites. Earcatch cannot be held responsible for the use of personal data by the organizations that offer these websites. Please read the privacy statement, if available, of the website in question.
